The U.S. Supreme Court has declined a request from Alabama to proceed with a scheduled execution using nitrogen hypoxia. The decision prevents the state from moving forward with the execution at this time.
The ruling follows a lower court determination that the method of execution via nitrogen gas is unconstitutional. Because of the Supreme Court's action, the execution of Jeffrey Lee will be delayed, although he continues to face the death penalty.
Within the Supreme Court, the decision was not unanimous. Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch dissented from the ruling that blocked Alabama's request.
As a result of the court's intervention, the state cannot proceed with the nitrogen gas execution as previously scheduled.
