Lindsay Clancy’s attorney, Kevin Reddington, publicly requested a pardon from President Donald Trump for his client, despite the case being a state matter. Clancy was on trial for the deaths of her three children – Cora, 5, Dawson, 3, and Callan, 8 months old – at their Massachusetts home in January 2023. The trial ended in a mistrial last week after the jury could not reach a unanimous verdict. Reddington argued Clancy was experiencing postpartum psychosis and acting on auditory hallucinations at the time of the killings, while prosecutors maintained she acted knowingly and planned the deaths.
Reddington, speaking on “Good Morning America,” stated, “Mr. President, I would hope that you would consider this young lady and the person she is, what she’s been through, and consider a pardon.” Trump had previously commented on the case, calling it “horrible” but acknowledging the possibility of a mental institution or jail time. The White House referred all inquiries to Trump’s prior statements. While Trump’s pardon power extends only to federal crimes, several sources noted Trump previously issued a pardon in a state case, potentially setting a precedent.
Reddington also indicated he hopes to reach an agreement with Plymouth County District Attorney Timothy Cruz regarding a potential plea deal or retrial. Cruz has stated the commonwealth may retry Clancy or offer a plea, but maintains the evidence showed Clancy intentionally killed her children. The jury was reportedly split 11-1, with Reddington believing the majority favored a not guilty verdict based on lack of criminal responsibility, though he has not spoken to any jurors. He defended the right of the holdout juror to maintain their position, while also expressing frustration that they did not follow the law. The case is scheduled to be discussed in court on September 29th to determine next steps.
