Virginia Supreme Court Overturns Democratic-Drawn Congressional Maps, Restores 2021 Boundaries

The Virginia Supreme Court, in a 4-3 decision, struck down newly enacted congressional maps that would have given Democrats a significant advantage in the state’s U.S. House delegation. The ruling restores the district boundaries drawn by court-appointed special masters in 2021, which were used in the 2022 and 2024 elections.

After the 2020 census, Virginia’s independent redistricting commission deadlocked, and the state Supreme Court assumed responsibility for drawing new maps. The court-issued maps were used in the 2022 midterms and the 2024 elections, in which Democrats won six of the state’s 11 House seats. Following the 2024 election, the Democratic-controlled legislature convened a special session and passed new maps that would have likely given Democrats 10 of the 11 seats, according to analyses. Democrats argued that the 2021 maps were unconstitutional because they violated the state constitution’s “single subject” rule, which requires laws to address only one topic.

The Virginia Supreme Court majority held that the legislature lacked authority to redraw congressional districts outside the decennial redistricting process. The state constitution, the court said, permits redistricting only once per decade following the census. The new maps, enacted in 2025, were therefore invalid. The court’s decision reinstates the 2021 maps for the 2026 midterm elections.

Vox reported that the court’s decision contained a “glaring error,” arguing that the single-subject challenge to the 2021 maps had merit and that the legislature was within its rights to correct an unconstitutional map. The New York Times noted that the ruling was a major lift to Republican efforts to build a structural advantage through redistricting, as the 2021 maps had already produced a relatively balanced delegation.

The ruling is final unless appealed to the U.S. Supreme Court, though legal experts noted that state constitutional questions are typically settled by state high courts.
